'Tis the season to be Skateful. Join us Saturday, Nov 7, 1 PM to 3 PM at Fort Dupont Ice Arena for a free community skate, teaturing Girls' Learn to skate for free and partiicpate in a fun filled event with live DJ, vendors and fun host DISTRICT ICE RINK — ASSUMPTION OF RISK, WAIVER OF LIABILITY & RELEASE AGREEMENT PLEASE READ CAREFULLY BEFORE PURCHASING A TICKET OR PARTICIPATING IN THE EVENT. By purchasing a ticket, clicking “I Agree” or the designated waiver acceptance button, checking in, entering the ice rink, or participating in any activity associated with the District Ice Rink Learn-to-Skate Event (the “Event”), I acknowledge and agree to the following terms, to the extent permitted by applicable law. 1. Assumption of Risk I understand that ice skating and learn-to-skate activities involve inherent and potentially serious risks, including, but not limited to, slips, falls, collisions with other participants or objects, loss of balance, cuts, bruises, sprains, fractures, head injuries, concussions, permanent disability, and death. I understand that these risks may arise from my own actions, the actions of others, ice conditions, equipment, rink conditions, or other circumstances. I voluntarily choose to participate in the Event and knowingly assume all inherent risks associated with attending, entering, observing, or participating in the Event, including risks that may result in personal injury, illness, property damage, or death. 2. Waiver and Release of Liability To the fullest extent permitted by applicable law, I release and agree not to hold liable the Event organizers, District Ice Rink, the rink or facility owner and operator, event hosts, sponsors, partners, affiliates, employees, officers, directors, agents, volunteers, instructors, contractors, representatives, and their respective successors and assigns (collectively, the “Released Parties”) for claims, demands, damages, losses, costs, or liabilities arising out of or relating to my attendance at or participation in the Event, including claims for personal injury, property damage, or death resulting from the inherent risks of ice skating and related activities. This release applies to the extent permitted by law and does not waive or exclude any liability that cannot legally be waived, including any liability for gross negligence, reckless conduct, or intentional misconduct where such exclusion is prohibited by law. 3. Agreement Not to Sue To the fullest extent permitted by applicable law, I agree not to bring or maintain a claim or lawsuit against any Released Party for matters covered by this Waiver and Release of Liability. I understand that this agreement is intended to release the Released Parties from covered legal claims arising from the risks of attending or participating in the Event, subject to applicable legal limitations. 4. Medical Treatment I understand that participation may result in injury requiring medical attention. In an emergency, I authorize Event personnel to seek emergency medical assistance on my behalf when reasonably necessary. I understand that I am responsible for any medical expenses incurred on my behalf, except as otherwise required by law. 5. Voluntary Participation and Acknowledgment I confirm that I have read and understood this Agreement, that I am voluntarily accepting its terms, and that I have had the opportunity to ask questions before agreeing. I understand that I am giving up certain legal rights by accepting this Agreement. I understand that clicking “I Agree,” purchasing a ticket after affirmatively accepting this Agreement, or otherwise affirmatively accepting this Agreement electronically is intended to constitute my acknowledgment and acceptance of these terms. Mere attendance, entry, or participation without an effective opportunity to review and accept the Agreement shall not, by itself, be treated as conclusive proof of consent where applicable law requires affirmative agreement. 6. Minors A parent or legal guardian must review and sign this Agreement on behalf of any participant under the age of 18, where required by applicable law. A minor's parent or guardian should not assume that signing this Agreement eliminates all legal rights belonging to the minor. Additional consent or documentation may be required. 7. Severability and Governing Law If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law. This Agreement shall be interpreted in accordance with the applicable laws of the District of Columbia, without displacing any mandatory law that applies.
